Eureka City Manager Dave Tyson won’t be getting off so easy.
A court ruling dismissing Tyson from a major harassment lawsuit against him and the city has been appealed by attorneys for former EPD dispatcher Tawnie Hansen. The appeal was filed Thursday.
Humboldt County Superior Court judge John Feeney dismissed Tyson from personal liability in the case in January, but cleared the way for Hansen’s case to proceed against the city.
The lawsuit is based on an anonymous blog allegedly run from inside the Eureka Police Dept. that peddled salacious gossip about an alleged affair between Hansen and Police Chief Garr Nielsen. Both have denied the rumors.
Hansen alleges that Tyson failed to prevent the workplace harassment by pursuing an over-broad “global investigation” that effectively buried her complaints, and that Tyson aided and abetted the harassment. She is seeking $1.4 million in damages.
An earlier lawsuit was settled when another former dispatcher, DeeDee Wilson, agreed to pay Hansen $10,000 following allegations of libel and intentional infliction of emotional distress.

On March 4, Easter Sunday, at about 8 a.m., the Eureka Police Department received a report of a partially submerged vehicle in Humboldt Bay under the Samoa Bridge. EPD responded to the scene along with the Eureka Fire Department.

The Eureka Police Department has determined that a vehicle found submerged in Humboldt Bay under the Samoa Bridge on Sunday was stolen. EPD received a report of the partially submerged vehicle at about 8 a.

Slide again closes Hwy. 199 for hours
Another rock slide closed U.S. Highway 199 near Patrick Creek for most of Thursday, the third time in three months the roadway has been completely blocked to traffic in that area.
Caltrans maintenance crews worked on Hwy. 199 until about 5 p.m. Thursday, when it was reopened. They cleared 2,000-3,000 tons of debris — the equivalent of 200-300 dump truck loads. Officials with the state agency said the recent spat of rock slides is due to the geology of the area and winter weather conditions.

The two Eureka Police Officers who fired weapons in the fatal incident that killed David Sequoia (aka David Barger) last week have been identified as Rodrigo Sanchez and Patrick Bishop. A third officer on the scene who did not fire his gun is identified as Brian Stephens.

Homeowner Kris Coon says EPD saved his life when 25-year-old David Sequoia was shot dead by Eureka Police. Coon says Sequoia was an intruder on Coon’s property and he refused to comply when police asked him to not reach for his gun.

Following several recent assaults on police officers the Eureka City Council passed a resolution Tuesday encouraging the District Attorney to prosecute such assaults to the fullest extent of the law.
Eureka City Councilman Larry Glass introduced the resolution, which passed unanimously. Councilman Frank Jager said he supported the resolution and added that assaults on officers should not be subject to plea bargains.
District Attorney Paul Gallegos did not attend the meeting.
Glass said the resolution was meant to support progress by EPD, which is following a policy of minimal force during arrests. The positive changes have come under the leadership of chief Garr Nielsen who took over the department in the wake of several officer involved shootings in 2006.

A Humboldt County man is facing a 380-year prison sentence after being convicted of repeatedly raping his stepdaughters and wife over several years. A Humboldt County Superior Court jury deliberated for two days before finding Paul Alan Jasnosz guilty Friday of 44 felonies, including 31 counts of forcible rape.
